WASHINGTON – The Department of Health and Human Services has changes to the Stark Law that would, among other things, create new exceptions that recognize incentives are different in healthcare systems that pay for value- vs. volume-based care. The proposal includes proper safeguards that ensure the Stark Law will continue to provide meaningful protection against overutilization and other harms, while giving physicians and other healthcare providers added flexibility to improve the quality of care for their patients, HHS says. “Our proposed rules would be an unprecedented opportunity for providers to work together to deliver the kind of high-value, coordinated care that patients deserve,” said HHS Secretary Alex Az.

10/08/2019. HME News Staff. ATLANTA – SleepMed, one of the largest operators of sleep labs in the United States, has acquired the assets of NovaSom, a leading provider of home sleep testing. It was previously reported that VirtuOx would buy the Glen Burnie, Md.-based company’s assets. SleepMed, a BioSerenity company, is “excited to invest in NovaSom,” said Roger Anderson, senior vice president of finance and operations. The company plans to combine its sleep medicine with NovaSom’s HST and BioSerenity’s technology and cloud platform to expand its U.S. operations. Previously, in court documents related to its Chapter 11 bankruptcy filing in August, NovaSom sought to sell its to VirtuOx through a stalking horse auction for an estimated $5.3 mil.

WASHINGTON – Industry stakeholders agree that fee schedule amounts for new technology are an issue that needs to be addressed, but when CMS publishes its final rule in the next few weeks, they say the best-case scenario might be the status quo. CMS published a in July detailing a framework for establishing fee schedule amounts for new HCPCS codes, but it still relies on a gap-fill methodology that stakeholders say—and even CMS itself has said in the past—is flawed. "I think the best-case scenario is for them to set this aside and not to move forward with their recommendations," said Kim Brummett, vice president of regulatory affairs for AAHomecare.

REDDING, Calif. – With the fall wildfire season underway in California, HME providers are making sure their oxygen therapy patients are prepared to be without power more often. For the first time, Pacific Gas & Electric, Southern California Edison and other electric companies say they plan to cut off power to certain areas when the fire risk is deemed high, generally due to high winds. "SoCal has come out and said, ‘If we have something that might stress the power lines, we are just shutting it down,’" said Glenn Steinke, president of Bishop-based Airway Medical.

10/04/2019. Liz Beaulieu. LARGO, Fla. – The issue of ATPs "scribing" or completing medical justification documentation for therapists has come to a head for Custom Mobility. The company recently sent out an email notifying therapists in its area that the practice potentially violates self-referral laws and anti-kickback statues, because it allows therapists to bill for more services and it allows certain ATPs to become referrals of choice. "It has gotten to the point where therapists are telling our ATPs, ‘If you’re not going to provide me with assistance, I’m going to refer my business elsewhere,’" said Barbara Berenger, funding and billing director.

The company, which provides integrated logistics, warehousing, service/repair, documentation management and other related services for respiratory equipment, has secured a $5 million straight equity investment from Aeonic Partners, a New York-based private equity firm. “We needed a significant investment if we wanted to do something that big that quickly,” Bala said.
