It is common for a pharmacy to have an indemnification agreement in its contract with a distributor. Most such agreements require the distributor to indemnify (repay) the pharmacy if the pharmacy is held liable for a defect in the product provided to the pharmacy by the distributor. An indemnity agreement may also require the distributor to pay for the pharmacy’s legal defense in a lawsuit based on product defect. A recent case in California clarifies how indemnification agreements work.

California became the first state to authorize pharmacists to dispense HIV prevention medications, including both pre-exposure prophylaxis (PrEP) and postexposure prophylaxis (PEP), without a physician’s prescription. The groundbreaking legislation was made official on October 7 after Gov. Gavin Newsom signed SB 159 into law.

Dry eye is characterized by a normal-appearing white sclera or a mildly red eye and patient complaints of a sandy, gritty feeling or a sensation that something is in the eye. There are three severity levels of this condition: mild, moderate, and severe. Abnormalities in the tear layer cause less than optimal lubrication of the ocular surface, with subsequent inadequate tear production. Increased severity of the condition can lead to severe damage to ocular tissues, particularly the corneal surface.

Lately, I’ve been hearing a lot about pharmacy “touches.” An ambulatory care pharmacist colleague described a shift in recent years in the way she documents her impact on patient care in her multidisciplinary clinic practice. She said that she previously tracked only the number of scheduled visits for chronic disease management, but she has realized that she affects patients’ care in so many other ways. Whether in a hallway consult with a physician about a drug therapy change, in an impromptu patient education session, or through efforts to help a patient afford a new medication, she improves care through many avenues, and she now keeps track of all these big and small patient “touches.”
